Wherein Cam gets seriously pissed
Feb. 18th, 2006 09:24 amRAGE (Reported at the BBC as well here.)
The supreme court agreed, saying that because of her previous sexual experiences, the victim's "personality, from a sexual point of view, is much more developed than what would be normally expected of a girl of her age".
"It is therefore fair to argue that (the damage for the victim) would be lower" if the abused girl was not a virgin, Italian news agencies quoted the court as saying
What the FUCK is that shit? Way to go, all-male Italian Supreme Court. Should we except lower punishment for rapes now if the female also dressed more 'sexually provocative'? Because clearly, that indicates more sexual maturity and therefore lower demage for the victim. Oh yes.
GAH.

Gah. I seriously want to crawl back under the covers and pretend that my country does not suck so much.
Now, something about the ruling of the Supreme Court that wasn't mentioned in the BBC article.(I'm not sure I'll be able to explain this cealry in English, please forgive me).
The ruling ( which was made by the "terza sezione penale" -- one of the lower sections of the Corte di Cassazione - aka Italian Supreme Court) was severely criticised also by the higher members of the Court, who said "this ruling is pure ignominy and we will do everything in our power not have it make it to the Massimario (collection of all the rulings of the Supreme Court which is used as an example for future reference)".
At least they're trying to do some damage control. *sigh*
Now I think I can go back in my corner and bang my head against the wall.

Date: 2006-02-18 01:24 pm (UTC)Though I must say that, while the Church's influence on Italian politics is still as strong as ever, I've seen signs that public opinion is slowly (painfully slowly) snapping out of it, so to speak.
One can only hope.

Date: 2006-02-18 07:26 pm (UTC)This is insane to the nth degree. WTF?! How can they sleep at night? Do these people live in the same world as the rest of us, or are they somewhere on Mt. freakin Olympus, watching the mortals go by and making their decisions? Who do they think they are?
And what rock have they been under for the past CENTURY?!?!

Date: 2006-02-18 09:35 pm (UTC)They neglect to mention how the said person isn't a virgin...what if a girl in that situation had lost hers due to rape? The trauma could easily be greater than it would be for a virgin.
Oh, and there's the fact that a girl who's only slept with her boyfriend and loves him to bits might feel that she'd betrayed him somehow. And that love and violence are, you know, completely different things.

Date: 2006-02-20 12:38 am (UTC)Now I'm NOT SAYING that I agree with these assholes even the tiniest bit, but let's play devil's advocate for a moment, shall we? Let's say, for a moment, that this incredibly offensive and outrageous conclusion is true: "There is *slightly* less psychological damage done to a rape victim that has had some previous sexual experience."
Okay. SO WHAT? Does it MATTER that it's slightly less? It's like saying, 'Oh yes, well, infinite irreparable damage is a lot, and that's unnacceptable. But this, well! THIS is infinite irreparable damage - minus ONE! So that's all right.'
I, of course, would like to point out that I was raped as a small child with no previous sexual experience. I don't remember the incident, but I am a different, much more broken person as a result. But guess what else? I was raped later in life, by two different men - first when I was 17 and had STILL had no previous consensual experience, and then later by the Troll - yes, MY HUSBAND THE TROLL - after (obviously) I was no longer so 'inexperienced'. And you know something? I feel that the rape which did the most psychological damage to me was the last. Of course, it went on for over a year, so that didn't help.
The point is, OBVIOUSLY, that rape is a violent act which has nothing to do with sexuality. It has to do with control, hatred, and cruelty. The victim is ALWAYS BLAMELESS. The victim, in fact, has nothing whatsoever to do with the nature or severity of the crime.
This has made me want to go vomit until I pass out.
